ArxRobot and ArxRobot Control Panel User Data Policy

This User Data Policy governs your use of the software application ArxRobot (“Application”) for mobile devices and its adjunct, the ArxRobot Control Panel desktop application, both of which were created by Arxterra.  At this time, the mobile device Application is in the alpha test phase of development, available only to those who opt-in to our testing program, and is not exposed to the general public.

The Application is a dual mode controller for Arxterra-compatible robots.  In Simple RC mode, ArxRobot acts as your remote control, communicating via Bluetooth with your robot’s micro-controller board.  In Community mode, your mobile device rides on your robot, acting as its control relay and sensor package, making use of WIFI, camera, microphone, GPS, gyroscope, accelerometer, etc., and you pilot it from the ArxRobot Control Panel desktop application.

What information does the Application obtain and how is it used?

User Provided Information

We obtain the information you provide when you opt-in to our testing program and download, specifically your name and email address.
When you use the Application in Simple RC mode, no information is shared publicly.  This is strictly a local line of sight Bluetooth connection between your mobile device and your robot, limited to a radius of approximately 10 meters.

If you wish to use Community mode, you may choose to allow your mobile device to send its GPS coordinates and audio/video stream via client-server architecture for you to monitor on the ArxRobot Control Panel desktop application.

We may also use the information you provided us to contact you from time to time to notify you of software updates to add new features and fix bugs.

Automatically Collected Information

In addition, the Application may collect certain information automatically for temporary use during a session, including, but not limited to, the type of mobile device you use and its screen size and orientation.

Does the Application collect precise real time location information of the device?

When you use the Application in Community mode, we use GPS technology to display your mobile device’s current location on the Arxterra Control Panel map, to aid you in remotely piloting your robot.  During the session this information will be visible also to others using the system (hence the term “Community”).  However, the information only exists in real time and is not recorded or stored by us in any manner.

If you do not want us to use your device’s location for the purposes set forth above, you should use the Application in Simple RC mode only.

Do third parties see and/or have access to information obtained by the Application?

Only when operating in Community mode.  When you board your robot as pilot via the ArxRobot Control Panel desktop application, then anyone else simultaneously using the ArxRobot Control Panel desktop application may see your robot’s location displayed on the map.  If they board your robot as an observer, they can see your mobile device’s video stream and, if you specifically enable it, also hear the audio from your mobile device’s microphone.

We may disclose User Provided information, which at this time consists solely of name and email address:
•    as required by law, such as to comply with a subpoena, or similar legal process;
•    if Arxterra is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our Web site of any change in ownership or uses of this information, as well as any choices you may have regarding this information.

What are my opt-out rights?
You can stop all collection of information by the Application easily by either limiting your use to the Simple RC mode, or by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network.  You can also request to opt-out via email, at arxterra@gmail.com.

Data Retention Policy, Managing Your Information
We will retain User Provided data for as long as you remain in our testing program and for a reasonable time thereafter.  If you’d like us to delete User Provided Data that you have provided, please contact us at arxterra@gmail.com and we will respond in a reasonable time.

Children
We do not use the Application to knowingly solicit data from or market to children under the age of 13.  If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at arxterra@gmail.com.  We will delete such information from our files within a reasonable time.

Security
We are concerned about safeguarding the confidentiality of your information.  We provide physical, electronic, and procedural safeguards to protect information we process and maintain. For example, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve our Application. Please be aware that, although we endeavor provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.

Changes
This User Data Policy may be updated from time to time for any reason. We will notify you of any changes to our User Data Policy by posting the new User Data Policy here and informing you via email. You are advised to consult this User Data Policy regularly for any changes, as continued use is deemed approval of all changes.

Your Consent
By using the Application, you are consenting to our processing of your mobile device’s information as set forth in this User Data Policy now and as amended by us. “Processing,” means streaming GPS, video and audio data in real time during a Community mode piloting session.
